In 2014, Jordan was convicted of first-degree manslaughter for the murder of his son. Jude Milla by administering a lethal dose of prescription drugs in 2010. The case received a great deal of media attention because Jordan’s alleged abuse was the result of a message she believed her son had typed into a simple communications device. ” said he responded.
A jury found Jordan guilty of manslaughter rather than the murder he was originally charged with, in favor of Jordan’s claim of extreme emotional disorder. Following his conviction, Jordan appealed for procedural irregularities that occurred during the trial.
Specifically, the presiding judge closed the courtroom for off-the-record discussions over the prosecutor’s request and Jordan’s legal team’s objection. The prosecutor used the argument to voice his concerns about media coverage of the trial and asked the judge to caution jurors not to view internet content related to the case.
The judge did so, and also warned Jordan herself about the inappropriate remarks she made online about the incident.
Jordan then appealed, claiming that procedural deficiencies had deprived her of her constitutional right to a speedy and public trial.
At the lower state court level, Jordan’s appeal fell through after it was found that the closed-door proceedings did not affect the content of the case before the jury. However, the United States District Court for the Southern District of New York disagreed, granting Jordan habeas corpus under the federal government and ordering Jordan to be released from state custody on bail pending the conclusion of the appeal.
The United States Court of Appeals for the Second Circuit overturned this, and Jordan filed an emergency appeal to the Supreme Court.
On December 20, 2022, Judge Sotomayor (Chairman of the Second Circuit) urgently granted bail to Jordan, awaiting further action by the parties.
